Termination of an employment contract by the employee: letter generator
Answer the questions about your contract and length of service, and the generator will show the notice period and your last day of work, then prepare the letter. You can also terminate the contract without notice if the employer has seriously breached its duties.
Only your browser processes the data you enter in the form. We do not save it or send it to a server. It disappears when you close the tab.
The document is created in Polish. The letter goes to a Polish authority or employer, and Polish is the official language in Poland (Article 27 of the Constitution). The form and tips are translated, but we generate the letter in Polish. Write your description of the matter in Polish or ask someone to help you translate it.
How to use the generator
- The notice period for fixed-term and indefinite contracts depends on your length of service with the employer: 2 weeks (less than 6 months), 1 month (at least 6 months), 3 months (at least 3 years). The notice period itself counts towards length of service.
- Length of service with an employer is the sum of all periods of employment with that employer, including those separated by breaks (breaks do not count, overlapping periods count once). It also includes employment with a predecessor after a transfer of the workplace (Article 36 § 1(1) and Article 23(1) of the Labour Code) and documented periods of a mandate contract, agency contract or business activity performed for this employer (Article 302(1) § 8 of the Labour Code). If an earlier period is not documented, or you are not sure whether there was one, the generator does not calculate the notice period automatically.
- A period counted in weeks ends on a Saturday, and a period counted in months ends on the last day of the month (Article 30 § 2(1) of the Labour Code).
- Termination without notice under Article 55 § 1(1) requires a serious breach of duties by the employer, e.g. persistent non-payment of wages. You have one month from the day you learned of the breach. In a dispute, the employer may claim compensation if there was no breach, so if in doubt use the free PIP advice.
