Deadline to appeal a District Labour Inspector's decision: calculator
An appeal against a decision establishing an employment relationship is filed in writing, via the District Labour Inspector, within one month of the day the decision was served (Article 477(7b) § 1 of the Code of Civil Procedure). The calculator shows the last day of this period.
How we calculate
- A period expressed in months ends at the end of the day whose date corresponds to the starting day of the period. If there is no such day in the month, the period ends on the last day of the month (Article 112 of the Civil Code).
- If the end of the period falls on a Saturday or a public holiday, the period ends on the next day that is neither a Saturday nor a public holiday (Article 115 of the Civil Code).
- These provisions apply to procedural deadlines under Article 165 § 1 of the Code of Civil Procedure.
The calculator does not assess when the decision was validly served. If a delivery notice was left and the item was not collected, the day of service may differ from the day you saw the letter. Check the instructions in the decision. If in doubt, file the appeal earlier or consult a lawyer.
